General Terms of Use and Parking Reservation

These General Terms of Use and Parking Reservation govern the conditions of access to, use of, and departure from parking locations available through the joint Parkiraj BL service, as well as the manner of submitting, processing, and confirming reservation requests via the website parkirajbl.com.

Parkiraj BL is the joint name and digital service through which three legal entities enable browsing of parking locations, display of basic information, submission of reservation requests, and communication with users. The provider of the specific parking service and the user’s contractual counterparty is the legal entity that manages the selected parking location.

By using the parking facility, entering a vehicle onto the parking premises, taking a parking ticket, registering a licence plate, or submitting a reservation request, the user confirms that they are familiar with these General Terms and accept them.

1. Legal entities and parking locations

Responsibility for the performance of the parking service, the condition and maintenance of the parking location, charging, video surveillance, handling of on-site events, and handling of complaints rests with the operator of the specific parking location, except where the request relates solely to the technical operation of the joint Parkiraj BL web platform.

2. Definitions

Parkiraj BL means the joint name and digital service of the parking operators listed above.

Parking means an open parking area, garage, or other parking location included in the Parkiraj BL service.

Operator means the legal entity that manages a specific parking location and provides the parking service.

User means a natural or legal person who uses the parking facility, submits a reservation request, or on whose behalf a vehicle is used.

Vehicle means a motor vehicle that enters the parking facility or that is stated in a reservation request.

Reservation request means a user’s request to use available parking capacity at a specific location and for a specific period.

Reservation confirmation means an email or other written electronic message informing the user that their request has been accepted.

Price list means the applicable prices, tariffs, and method of calculating the service charge at a specific parking location.

Third party means any person who is not the operator of the specific location, its employee, or the user to whom the specific service relates.

3. Application of the General Terms

These General Terms apply together with:

  • the applicable price list of the specific parking location;
  • the special rules of the specific parking location;
  • the Rules on Use of Parking and Reporting of Damage;
  • the Privacy Policy;
  • the Cookie Policy;
  • the notice on video surveillance;
  • physically displayed traffic signs, markings, and instructions at the parking facility.

In the event of a difference between these General Terms and the special rules of a specific parking location, the special rules of that location shall apply, provided that they were clearly available to the user before use of the service.

4. Nature of the service

The service consists of enabling the use of available parking space in accordance with these General Terms, the rules of the specific location, and the applicable price list.

Unless expressly agreed otherwise in writing for a particular service, use of the parking facility:

  • does not constitute a contract for safekeeping of the vehicle;
  • does not imply taking custody of the vehicle, keys, or vehicle documents;
  • does not imply that the operator assumes factual control or possession of the vehicle;
  • does not imply supervision of the contents of the vehicle;
  • does not constitute a guarantee of protection of the vehicle against any theft, damage, vandalism, or act of a third party.

Operators do not take possession of vehicle keys. The user parks, locks, and retrieves the vehicle independently.

The presence of employees, controllers, lighting, entry or exit barriers, cameras, or video surveillance does not mean that the operator assumes an obligation to safeguard the vehicle or items left in the vehicle.

5. Formation of the contractual relationship

A contractual relationship between the user and the operator of the specific parking location arises, depending on the manner of using the service, upon:

  • entry of the vehicle onto the parking premises;
  • taking or activating a parking ticket;
  • registration of the vehicle licence plate;
  • acceptance of a confirmed reservation request;
  • payment of the charge;
  • any other clear commencement of use of the service.

Submitting a form via the website constitutes only the submission of a reservation request. Mere submission of the form does not automatically mean that the reservation has been accepted, and parking capacity is not guaranteed.

6. Submission of a reservation request

The user submits a reservation request by entering the data required in the form, which may include:

  • start date of use;
  • end date of use;
  • planned arrival time;
  • planned departure time;
  • number of additional days;
  • selected parking location;
  • vehicle licence plate;
  • email address;
  • telephone number.

The user is responsible for the accuracy, completeness, and currency of all data entered. Before submitting a request, the user must carefully verify the licence plate, selected location, date, time, and contact details.

The operator is not liable for inability to use a reservation, additional costs, or other consequences arising from inaccurate, incomplete, or outdated data entered by the user.

7. Confirmation of a reservation request

A request is deemed accepted only when the user receives an express reservation confirmation at the email address stated in the form.

An automated message that confirms only receipt of the request does not constitute final reservation confirmation if that message states that the request still needs to be processed.

The operator may refuse a request in particular where:

  • there is no available parking capacity;
  • the data entered are incomplete or clearly inaccurate;
  • the selected location is temporarily out of operation;
  • there is a technical failure or system interruption;
  • the request is not in accordance with the rules of the location;
  • there are reasonable grounds to suspect misuse of the service.

Where possible, the user will be notified of the refusal or inability to accept the request via the email address or telephone number provided.

8. Availability of parking capacity

Data on the number of free spaces displayed on the website may be based on manual entry or data received from an external information system. The displayed number is for informational purposes and may change between the moment of display, submission of the request, and the user’s arrival.

An accepted request relates to available capacity at the specific location and not to a precisely designated or numbered parking space, unless expressly stated otherwise in the confirmation.

The operator will take reasonable measures to ensure that displayed data are accurate and up to date, but does not guarantee uninterrupted system availability, fully real-time refreshing, or the complete absence of technical errors.

9. User arrival and validity period of a confirmed request

The user must arrive at the time stated in the reservation confirmation.

If the user does not arrive at the parking facility within five hours of the planned arrival time, the operator is entitled to release the previously reserved capacity and make it available to other users.

After the expiry of five hours from the planned arrival time, availability of parking capacity is no longer guaranteed. A user who arrives after that period may use the parking facility only if free capacity exists at the time of arrival.

Earlier arrival or later departure may be additionally charged according to the applicable price list of the specific location.

10. Amendment and cancellation of a request

A request to amend or cancel a reservation is submitted by the user via email to info@parkirajbl.com or another contact stated in the reservation confirmation.

The request should contain at least:

  • the reservation number, if assigned;
  • the user’s first and last name;
  • the vehicle licence plate;
  • the parking location;
  • the date and time of the reservation.

An amendment depends on available capacity and is not deemed accepted until the user receives a new written confirmation.

The operator may restrict future reservations for a user who repeatedly submits requests without a genuine intention to use the service or who otherwise misuses the system.

11. Prices, currency, and method of payment

The charge for use of the parking facility is calculated according to the price list applicable to the specific location at the time of use of the service.

All prices, calculations, and payments are stated and effected exclusively in convertible marks, i.e. the currency BAM.

Payment at physical parking locations is possible:

  • in cash;
  • by accepted payment cards.

Availability of a particular payment method may depend on the technical equipment of the specific location and must be clearly indicated at that location.

The website does not enable online payment. Submission of a reservation request via the website does not constitute payment effected.

The price may be calculated per commenced hour, per commenced day, according to a maximum daily tariff, a special multi-day package, or another model clearly stated in the price list.

If the user exceeds the declared or confirmed period of use, additional time is calculated according to the applicable price list.

12. Rules on entry, movement, and parking

The user must:

  • comply with traffic signs and markings at the parking facility;
  • follow instructions of employees and authorised persons;
  • move carefully and adapt speed to conditions at the parking facility;
  • park exclusively within a marked parking space;
  • use only a space appropriate for the type and dimensions of the vehicle;
  • enable unobstructed passage for other vehicles, pedestrians, and emergency services;
  • pay particular attention to children, pedestrians, and persons with reduced mobility;
  • stop the vehicle before the barrier and use equipment in accordance with instructions;
  • promptly report any malfunction, hazard, or damage to equipment.

The maximum permitted speed at parking locations is 20 km/h, unless a lower limit is set by traffic signs at the specific location.

13. Prohibited conduct

At the parking facility it is prohibited to:

  • park outside marked spaces;
  • block an entrance, exit, barrier, fire access route, or another vehicle;
  • occupy a space designated for persons with disabilities without an appropriate entitlement or marking;
  • leave a vehicle that is leaking, smoking, on fire, or otherwise presents a hazard;
  • bring in or store explosive, flammable, toxic, or other dangerous substances;
  • wash, repair, or service a vehicle without the operator’s approval;
  • charge an electric vehicle other than at a charger designated for that purpose;
  • smoke or use an open flame in a closed garage;
  • damage a barrier, ticket machine, camera, signage, or other equipment;
  • leave a trailer, camper, or other unauthorised vehicle;
  • use the parking facility for selling vehicles, storage, or carrying on another activity;
  • leave a vehicle longer than the permitted period.

14. User obligations in relation to the vehicle

The user confirms that:

  • they are entitled to operate the vehicle;
  • the vehicle has valid registration and compulsory insurance;
  • the vehicle is in technically sound condition;
  • the vehicle’s dimensions and mass comply with the location’s limitations;
  • the vehicle does not present a hazard to people, property, or the environment.

The user must properly lock the vehicle, close the windows, and not leave keys, documents, money, electronic devices, or other valuables in plain sight.

The user bears liability for damage that they, their vehicle, passengers, items in the vehicle, or persons to whom they have enabled access to the parking facility cause to the operator, other vehicles, users, or third parties.

15. Liability for the vehicle and items in the vehicle

The user parks the vehicle at their own risk, except to the extent that the operator’s liability arises from mandatory statutory provisions.

The operator is not liable for damage that is not a consequence of its intent, gross negligence, failure to maintain, or other liability established by applicable regulations.

To the extent permitted by law, the operator is in particular not liable for:

  • a collision, contact, or other damage caused by another user or a third party;
  • damage caused by a known or unknown third party;
  • theft, attempted theft, or vandalism that the operator could not reasonably prevent;
  • loss of money, documents, keys, or other items from the vehicle;
  • damage arising from improper parking or conduct of the user;
  • damage arising from a technical defect of the vehicle;
  • self-starting of the vehicle;
  • leakage of fuel, oil, or other fluids from the vehicle;
  • damage caused by objects or cargo of another user;
  • hail, storm, flood, snow, ice, lightning strike, or other weather event;
  • damage caused by animals, rodents, or insects;
  • fire that is not a consequence of the operator’s failure;
  • actions of the police, firefighters, emergency medical services, or another competent authority;
  • circumstances of force majeure.

No provision of these General Terms excludes or limits liability that cannot be excluded or limited in advance under mandatory regulations.

16. Video surveillance

All parking locations included in the Parkiraj BL service are covered by video surveillance for the protection of persons and property, access control, clarification of incidents, and improvement of security.

Video surveillance:

  • does not constitute a vehicle safekeeping service;
  • does not constitute a guarantee that every event will be prevented, observed, or recorded;
  • may have a limited field of view;
  • may be temporarily unavailable due to failure, maintenance, or power interruption.

Responsibility for processing recordings at a particular location rests with the operator of that location, unless otherwise stated in the notice on video surveillance.

Detailed information on the purpose of processing, retention period, data recipients, and rights of individuals is available in the Privacy Policy and the separate Notice on Video Surveillance.

17. Failures and interruptions of operation

The operator may temporarily restrict or suspend access to the parking facility due to:

  • failure of a barrier, ticket machine, card terminal, or other equipment;
  • power outage;
  • interruption of internet or telecommunications connections;
  • error of an external information system or API service;
  • works, maintenance, or remediation;
  • security reasons;
  • a traffic accident;
  • fire, flood, or other emergency situation;
  • an order of a competent authority.

The operator will endeavour to restore regular operation within a reasonable time, but is not liable for delay or non-performance of an obligation caused by circumstances that it could not reasonably prevent, remedy, or avoid.

18. Improperly parked, dangerous, and abandoned vehicles

The operator may take proportionate measures when a vehicle:

  • blocks a passageway, entrance, or exit;
  • endangers people or property;
  • interferes with regular parking operations;
  • stands outside a marked space;
  • occupies a specially reserved space without authorisation;
  • has no licence plate;
  • is clearly abandoned;
  • presents a fire, environmental, or other risk.

Measures may include warning the user, attempting to contact the user, temporarily securing the area, notifying the police or another competent authority, and removing the vehicle in accordance with the law.

The user bears justified and documented costs arising from their breach of the rules, where there is a legal basis for doing so.

19. Damage caused by the user

The user must promptly notify the operator if they:

  • damage another vehicle;
  • damage a barrier, ticket machine, wall, fence, signage, or other equipment;
  • cause a leak, fire, or other incident;
  • notice a hazard to people or property.

Leaving the parking facility without reporting does not release the user from liability.

The operator is entitled to claim compensation for documented damage and reasonable costs arising from the user’s conduct.

20. Reporting vehicle damage or an incident

A user who believes that their vehicle has been damaged at the parking facility should:

  1. stop the vehicle in a safe place;
  2. not leave the parking facility before reporting, except where necessary to protect life, health, or property;
  3. contact an employee at the location or send a report to info@parkirajbl.com;
  4. photograph the vehicle, the damage, and the place of the event;
  5. provide the reservation or parking ticket number, if any;
  6. state the approximate time of the event;
  7. if necessary, call the police or another competent service;
  8. complete an incident report, when available.

Reporting an incident, preparing a report, or receiving documentation does not constitute an admission of the operator’s liability.

Late reporting may hinder or prevent establishment of the facts, particularly where relevant video surveillance recordings are no longer available in accordance with the prescribed retention period.

21. Complaints and objections

The user may submit a complaint or objection electronically to info@parkirajbl.com.

Parkiraj BL records receipt and forwards the complaint to the operator of the specific parking location. Responsibility for deciding and responding rests with the operator of that location, except where the complaint relates solely to the technical operation of the joint web platform.

A complaint should contain at least:

  • the user’s first and last name;
  • contact details;
  • the name of the parking location;
  • the date and time of the event;
  • the vehicle licence plate;
  • the reservation or parking ticket number, if any;
  • a clear description of the problem;
  • relevant photographs, receipts, and other documents.

The user is provided with a confirmation of receipt of the complaint. The operator will consider the complaint and respond within the period prescribed by applicable consumer protection regulations.

22. Protection of personal data

User data are processed for the purposes of:

  • receiving and processing reservation requests;
  • communication with the user;
  • recording use of the parking facility;
  • resolving complaints and incidents;
  • protecting people and property;
  • fulfilling legal obligations.

Detailed information on types of data, the legal basis for processing, retention periods, recipients, and user rights is set out in the Privacy Policy.

23. Use of the website

The user is prohibited from:

  • entering false data or another person’s data without authorisation;
  • submitting requests without a genuine intention to use the service;
  • attempting unauthorised access to the system;
  • interfering with or endangering the operation of the website;
  • automatically sending a large number of requests;
  • misusing the reservation system;
  • using another person’s contact details or licence plates without a legal basis.

Parkiraj BL may temporarily restrict access for a user or technical source that endangers system operation or misuses the service.

24. External technical services

The website may use third-party services, including Google Maps, hosting, email infrastructure, and other technical services.

Parkiraj BL and the operators do not fully control the availability of external services and do not guarantee their uninterrupted operation.

Use of particular external services may also be governed by the rules of their providers.

25. Force majeure

The operator is not liable for complete or partial non-performance of the service that is a consequence of events beyond its reasonable control, including natural disasters, fire, flood, war, riots, strike, interruption of electricity or telecommunications, actions of public authorities, and other circumstances of force majeure.

The operator will, where reasonably possible, take measures to mitigate consequences and notify users of a prolonged interruption of operation.

26. Amendments to the General Terms

These General Terms may be amended in order to align with regulations, change the manner of operation, introduce new parking locations or functions, change the technical system, or improve security.

Amended terms are published on the website with the effective date.

An individual reservation request is governed by the version of the terms that was in force at the time of its submission, unless a mandatory regulation requires otherwise.

27. Partial invalidity

If any provision of these General Terms is found to be invalid, void, or unenforceable, this does not affect the validity of the remaining provisions.

An invalid provision shall be replaced by a permissible provision that, in its purpose, is closest to the original provision.

28. Governing law and dispute resolution

These General Terms are governed by the applicable regulations of Bosnia and Herzegovina and Republika Srpska.

The operator and the user will attempt to resolve any dispute amicably.

If the dispute is not resolved by agreement, jurisdiction is determined in accordance with applicable regulations, without limiting the rights that belong to the consumer on the basis of mandatory statutory provisions.
